Preamble

The EVAL Health Limited Open Source App License is designed allow you to use, modify, distribute, and sell your applications exclusively on the EVAL Health platform.

Terms and Conditions

1. Definitions:

   1. "License" refers to this EVAL Health Limited Open Source App License.
   2. "Application" refers to any EVAL app created on the EVAL Health app platform.
   3. "You" refers to the licensee, the individual or entity using the Application.
   4. "Platform" refers to the EVAL Health app platform.

2. Grant of License:

   1. You are granted the right to use the Application exclusively on the Platform if you pay the license fee, unless the license fee is $0.
   2. You may modify the Application if you pay the fee to clone the app, unless the clone fee is $0.

3. Source Code:

   1. EVAL Health will make your source code available to anyone who receives access to the Application on the Platform.

4. Modifications and Derivative Works:

   1. Any modifications or derivative works of the Application must be licensed under this License.

5. Distribution and Sales:

   1. You may not sell the Application or modifications or derivative works of the Application.
   2. You may distribute modifications or derivative works of the Application privately through the Platform for free.
   3. You may not charge a fee for the modifications or derivative works of the Application, but it must remain under this License.

6. Charitable Donations:

   1. EVAL Health reserves the right to donate the Application to non-profit charitable organizations that provide free healthcare services. These organizations may use, modify, and distribute the Application under the same terms of this License.

7. No Warranty:

   1. The Application is provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.
   2. The entire risk as to the quality and performance of the Application is with you, the licensee.
   3. Should the Application prove defective, you assume the cost of all necessary modifications, servicing, repair, removal, correction, or any other related costs associated with the usage of the Application within your organization.
   4. Furthermore, any effects, damages, or losses resulting from the use of the defective Application are solely your responsibility. The authors or copyright holders shall not be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Application or the use or other dealings in the Application.
   5. Use at your own risk.

8. Acceptance:

   1. By using, modifying, distributing, or selling the Application, you indicate your acceptance of this License and all its terms and conditions.
